I posted awhile back here that this guy is suing me cause I hit him. He stopped on a yellow to red light and I thought he was going through and I kept going.. I glanced away for a half second. Damage was VERY minor, my airbags didn't even go off. His piece of crap old old work truck had slight damage, my vehicle had the worst damage to the front end. (How I had so much damage amazes me)... BUT anyways, there was no police report (they wouldn't come out if no one was hurt) we exchanged info and he went on his way and I had to get a tow.

Fast forward about six months. Get a call from my insurance saying he is suing for $100,000 for medical reasons. (I am in shock, cause it was not that bad)...and he won't settle for $30,000...which my insurance offered. The agent handling this suspects he is trying to milk this as much as possible.

This was in 2010... Insurance will not budge on anything.. He's threatening to sue... he has until Aug 2013. I called on the status and they settled!!! I don't know what he got but the best news is since I have had my insurance forever with no accidents or tickets.. no rate increase!! PHEW.. I thought for sure it was going to go through the sky!! Thank you State Farm... I them!! (I have had State Farm for about 20 years with hardly any increases except adding the kids the last few years....)

That's such good news! I hate people who inflate insurance claims- pity he got anything at all!

I love State Farm, we have been with them for 25 years. They have always handled our claims very well.

We had a person file a claim against us, when it was not our fault. Not a fun experience.

Glad that they got it settled for you. People like that man truly disgust me and are a lot of the reason insurance is so high for everyone.

That's way lame that he got anything. I thought a police report had to be filed if there was over $500 in damage. Glad it's off your shoulders now though.

How does the average person who has an accident know if the damage is over or under $500? I guess some are obviously over but under? I don't think many people would have a clue.

In my area, the police typically do not come to an accident unless there are injuries or cars are inoperable and blocking traffic. So, if OP needed a tow, they probably would have come. But, most people exchange information and go on their way. This will vary from area to area as to what happens with a wreck.

OP, glad to hear they settled. They usually do, but it is still nice to hear that it is officially over. I also have State Farm and so far so good. I might be able to save a few dollars somewhere else but in many cases, you get what you pay for when it comes to insurance. There is one other company we will consider if we ever decide to leave State Farm.

California law states you have to report any damages over $750.00 to DMV. Her insurance carrier probably took care of that for her.

And about the guy who sued your insurance company: Karma is a bitch!

YAY! BTDT, same exact story except they cancelled my insurance, including my parents & my siblings since I was still on my parent's policy. UGH! My mom swears she's STILL paying for that accident. I know how stressful that is & I'm happy for you!

Oh yes we know how this goes very well. My son was in an accident a few years ago. There was an accident already and my son was paying to much attention to that accident and he rear ended this guy, they were moving at about 10 miles an hour, cops were already there, they had to tell the guy he hit to stop his car, he didn't even realize that he had been hit! Then the guy sues for 300,000.00!

Well I called them and they wouldn't come out.. only asked about injuries.

I knew my damage would be over $500 (my dh is an auto mechanic by trade).... but the damage to my vehicle was over $7,000!!!! I thought it would be like $3,000.. I was SHOCKED... I was then hoping they would total it at that point, but no. And still no airbags going off...

I am so glad that it worked in your favor... my hubby was in a wreck a few years back and he is still trying to get it resolved. He was heading out to the airport and this lady decided to do an illegal u-turn right in front of him and yup, he hit her, totalled our car and he had to have surgery from the airbag blasting his arm as he was bracing for the impact, he had no chance of stopping. Our insurance has taken care of the medical bills and the car, but hers has done very little as she didn't have good coverage and it was her fault in the accident report. My hubby is a builder and he can't even lift a hammer without being in some kind of pain still... it has hurt us in so many ways, but yet, we have to sue our own insurance company to get anything... it is just wrong. I just know that once everything is settled they will drop us, it won't matter that we have had them for 20 years+. Oh, and she has had several ruin-ins with the cops so they even knew her which makes it even worse. Sorry to vent on your thread... just happy that it worked out well for you!!

Kinda makes you think he stopped on the yellow on purpose just SO that he could sue, doesn't it?!
